By downloading or using WhatArt ("App"), you agree to be bound by these Terms of Use. If you do not agree to these terms, do not use the App.

1. Use of the App

WhatArt is designed to identify and analyze paintings using AI technology. You agree to use the App only for lawful purposes and in accordance with these Terms. You agree not to:

• Use the App in any way that violates applicable laws or regulations
• Attempt to reverse engineer, decompile, or disassemble any part of the App
• Use the App to submit content that is illegal, offensive, or violates third-party rights
• Attempt to circumvent the free tier usage limits

2. AI-Generated Content Disclaimer

The painting analyses provided by WhatArt are generated by artificial intelligence and are provided for informational and entertainment purposes only. While we strive for accuracy:

• Results may not always be correct, especially for lesser-known or obscure works
• Value estimates are approximate and should not be relied upon for financial decisions
• Historical information may be incomplete or contain inaccuracies
• We are not responsible for decisions made based on AI-generated analyses

3. Subscriptions and Payments

• WhatArt offers free and premium subscription tiers
• Premium subscriptions are billed through Google Play on a monthly or annual basis
• Subscriptions automatically renew unless cancelled at least 24 hours before the renewal date
• Refunds are handled according to Google Play's refund policy
• We reserve the right to change pricing with reasonable notice

4. Intellectual Property

The App and its original content, features, and functionality are owned by NerdForm Labs LLC and are protected by international copyright, trademark, and other intellectual property laws.

By submitting painting photos for analysis, you grant us a limited, non-exclusive license to process those images solely for the purpose of providing the analysis service.

5. Privacy

Your use of the App is also governed by our Privacy Policy, which is incorporated into these Terms by reference.

6. Limitation of Liability

To the maximum extent permitted by law, NerdForm Labs LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages resulting from your use of the App, including but not limited to errors in AI-generated content, service interruptions, or data loss.

7. Termination

We reserve the right to terminate or suspend access to the App at our sole discretion, without notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties.

8. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of significant changes through the App. Your continued use of the App after changes constitutes acceptance of the new Terms.

9. Governing Law

These Terms are governed by the laws of the State of Wyoming, United States, without regard to conflict of law principles.
